HONOURABLE SRI JUSTICE A. RAJASHEKAR REDDY WRIT PETITION No. 18763 OF 2018.

O R D E R :

This writ petition is filed seeking mandamus to declare the action of the respondents 2 and 3 in involving in civil disputes, at the instance of respondent No.4 by summoning the petitioner to Police Station, threatening him not carry out further constructions, finishing works in his house property bearing Door No. 4-38-6/3/8, Deena Bhandu Colony, Yellamma Banda, Kukkatpally, Medchal district, as arbitrary, illegal and consequently to direct them not to involve in civil disputes and to pass such other suitable orders as this Court may deem fit and proper in the circumstances of the case.

2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the respondents.

3. The learned Assistant Government Pleader for Home submitted written instructions filed by the Sub-Inspector of Police, Jagadgirigutta Police Station stating that the respondents 2 and 3 never interfered with the civil disputes much less the dispute between the petitioner and the fourth respondent. In the absence of receipt of any complaint by fourth respondent, the question of summoning the petitioner to the police station does not arise.

4. Per contra, the learned counsel for the petitioner disputed the same.

5. In view of the above facts and circumstances, the writ petition is disposed of and the petitioner cannot be called to Jagadgirigutta Police Station except only in accordance with law and the respondents shall not interfere with the civil disputes between the petitioner and the fourth respondent.

5. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand disposed of. No costs. _____________________________ JUSTICE A. RAJASHEKAR REDDY.
