This petition is filed under section 438 of Cr.P.C. seeking release of the petitioner in the event of his arrest in Crime No.304/2015 of Station House Officer, V Town Police Station, Sri Potti Sriramulu Nellore District, registered for the offence punishable under Section 420 IPC. The allegations against the petitioner are that he made the informant believe that he would provide job to him and accordingly collected an amount of Rs.5,00,000/- and also took his HeroHonda Motor cycle. Thereafter his whereabouts are not know and is thus alleged to have cheated the informant. The learned counsel for petitioner submitted that the informant has not referred to any specific dates and other particulars in the report and though the incident was alleged to have occurred in the year 2014, lodged the report with false allegations on 1.8.2015.
The learned Additional Public Prosecutor opposed for grant of anticipatory bail.
A reading of the report would show that specific allegations are attributed against the petitioner in the report. Further the learned Additional Public Prosecutor on instruction submits that the petitioner, under the guise of providing job, collected an amount of Rs.5,00,000/- from the informant, Rs.3,00,000/- from Jageeswara Reddy, Rs.2,93,000/- from Petluru Srinivasulu and Rs.2,50,000/- from one Ashok. Having regard to the nature of allegations, I do not find any ground to grant anticipatory bail to the petitioner and the criminal petition is liable to be dismissed. Accordingly the criminal petition is dismissed. Miscellaneous petitions pending if any, shall stand closed. -------------------------------------
