P.V. Satya Krishna v. The Mahatma Gandhi National Rural
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.28550 OF 2017 ORDER:
This writ petition is filed challenging the proceedings in Rc.No.150/A.P.O/H.R, dated 08-12-2016, wherein the petitioner was suspended from service pending enquiry. Learned counsel for the petitioner says that basis of suspension order is without any ground. Since the petitioner was busy in the Mandal, to which he was allotted he was unable to attend the work at the Mandal where he was kept in-charge.
On the other hand, learned Standing Counsel for the respondents submits that already a show-cause notice was issued to the petitioner and he also submits that the petitioner has been entrusted some plants, but the same has not been accounted.
Truth or otherwise of the allegations cannot be gone into at this stage. Since it is stated that already a showcause notice was issued, the petitioner was kept under suspension on 08-12-2016, the competent authority is directed to conclude the enquiry within a period of six weeks from the date of receipt of a copy of this order. In default, the competent authority is directed to reinstate the petitioner into service.
With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 31-08-2017 Nvl
