HON'BLE SRI JUSTICE S.V.BHATT W.P.No.20654 OF 2011 ORDER:

The petitioners pray for the following relief: ".........this Hon'ble Court may be pleased to issue a Writ, order or direction more particularly one in the nature of mandamus declaring the action of the respondents in interfering with the petitioner's lands to an extent of 247.25 sq.yards and 281.25 sq.yards respectively situated in Sy.Nos.151, 152, 153, 154 of Shayampet Village and Sy.No.561, 562, 563, 564 and 566 of Urus Village, within the limits of Shayampet Gram Panchayat, Warangal District, as illegal, arbitrary, violation of principles of natural justice and in violation of Articles 14 and 300-A of the Constitution of India and consequently refrain the respondents 1 to 3 herein from entering into the petitioners' land and pass ........." This Court, on 22.07.2011, passed the following interim order: "...........until further orders, the petitioners may not be dispossessed from the lands to an extent of 247.25 sq. yards and 281.25 sq. yards respectively situated in Survey Nos.151 to 154 of Shayampet Village and Survey Nos.561 to 564 and 566 of Urus village."

At request of respondents, time was granted on 27.07.2016. The Assistant Government Pleader for Revenue, on instructions, submits that the allegation of unauthorized or illegal interference by respondents 1 and 2 is without basis. The Government Pleader appearing for 3rd respondent, on oral instructions, submits that the writ prayer against Excise Department is premature and the department is not interfering with the possession of petitioners. The statements of learned counsel are placed on record. The writ petition is, accordingly, disposed of by making the interim order dated 22.07.2011 as final order. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any pending, also stand closed.
