HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.5438 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Civil Supplies.

2. This writ petition is filed seeking writ of Mandamus declaring the action of the 2nd respondent in not passing stay order on the petitioner's stay petition filed along with revision petition against the order dated 09.10.2014 in Ref.H/343/2014 passed by the 3rd respondent, as illegal and arbitrary.

3. It is submitted by the learned counsel appearing for the petitioner that the petitioner was a permanent Fair Price shop dealer for Shop No.31, S. Moolapalem Village, Inavalli Mandal, East Godavari district. On 22.02.2014, the Deputy Tahsildar, Kothapet along with his staff, inspected the shop of the petitioner and levelled certain charges against the petitioner. Basing on the said charges, the 3rd respondent issued show cause notice to the petitioner and the petitioner submitted his explanation. The 3rd respondent without conducting any enquiry and considering the explanation of the petitioner passed an order on 09.10.2014 cancelling the authorisation of the petitioner. Thereafter, the petitioner preferred an appeal before the Joint Collector, East Godavari District and the Joint Collector disposed of the said appeal on 11.12.

2014 by confirming order of the 3rd respondent. Aggrieved by the said order, the petitioner preferred a revision before the 2nd respondent on 31.12.2014 along with a petition to stay of operation of the order of the 3rd respondent. The grievance of the petitioner is that the 2nd respondent has not passed any order either in the stay petition or in the revision.

4. Under these circumstances, the writ petition is disposed of directing the 2nd respondent to dispose of the revision petition as well as the stay petition filed by the petitioner, within a period of eight (8) weeks from the date of receipt of a copy of this order.
