THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.2133 of 2016 ORDER:
The prayer for the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a Writ, order or direction, more particularly one in the nature of Writ of Mandamus to declare the action of the respondent No.2 in not considering the representation made by the petitioner on 08.01.2016 in pursuance of letter issued by the Superintendent of Police Medak at Sangareddy vide Letter No.2010C1/DCRB-MDK/2015 dated 01.10.2015 and declare the same as illegal, unjust, arbitrary and consequently direct the 2nd respondent to accord permission to file Criminal Appeal as per the provisions of Section 378(1)(a) of Cr.P.C. against the order of the acquittal of the accused persons in CC No.
23/2015 on the file of Judicial Magistrate of First Class at Gajwal before the District & Sessions Judge Medak at Sangareddy and to pass such other order or orders may deem fit and proper in the circumstances of the case." Despite the matter being adjourned twice to enable the learned Assistant Government Pleader to get instructions in the matter, he was unable to do so.
As it is for the District Collector to grant necessary permission for filing of an appeal and as the petitioner had already submitted representation dated 08.01.2016 for such permission, the writ petition is disposed of directing the District Collector, Medak at Sangareddy, the 2nd respondent, to take appropriate action upon the petitioner's representation dated 08.01.2016. Owing to the delay of the District Collector in acting upon the said representation and in responding to this Court despite the matter being adjourned twice, this exercise shall be completed within one week from the date of receipt of receipt of a copy of this order.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
