This Writ Petition is filed for a Mandamus to

declare the seizure of the petitioner's lorries, bearing registration Nos.AP 03 TBOI 215 and AP 26 TT 3889 respectively, as illegal and arbitrary. At the hearing, the learned Assistant Government Pleader for Home (Andhra Pradesh), on instructions, submitted that following the seizure of the above mentioned two lorries, FIR No.114 of 2015 was registered, for the offence under Section 379 of the Indian Penal Code, 1860, on 05-10-2015 and that the seized lorries were produced before the Jurisdictional Magistrate and a charge sheet has been filed.

In the light of the above submission of the learned Assistant Government Pleader for Home, Mr.P.Gangarami Reddy, learned Counsel for the petitioners, submitted that his clients may be permitted to file appropriate application before the Jurisdictional Magistrate for release of the seized lorries.

Having regard to the above noted facts and submissions of the learned Counsel for the parties, the Writ Petition is disposed of giving liberty to the petitioners to move the Jurisdictional Magistrate for

release of the seized lorries.

As a sequel to disposal of the Writ Petition, WPMP.No.1834 of 2016, filed by the petitioners for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 20th January, 2016 lur
