THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 21980 of 2019 ORDER:
Admittedly, petitioners do not have interest over the property alleged to have been purchased by the sixth respondent from the original allottees. In view of the same, being individuals of the society, they cannot espouse the cause of public nature. The nature of relief, which the petitioners are seeking, can only be granted in a Public Interest Litigation. There is a separate procedure prescribed for filing Public Interest Litigation. When the same is pointed out, learned counsel for the petitioners seeks permission of this Court to withdraw the Writ Petition with liberty to the petitioners to approach the Court by way of filing Public Interest Litigation.
Permission is accorded and the Writ Petition is dismissed as withdrawn with liberty to the petitioners to approach the Court by way of filing Public Interest Litigation, by fulfilling necessary conditions therefor.
