HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.25084 of 2015 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties. The petitioner was appointed as a fair price shop dealer. His licence was renewed from time to time. The petitioner states that, despite his application for renewal of licence by paying requisite fee which is pending before the authorities, the respondents are not supplying the essential commodities. The present Writ Petition is filed seeking supply of essential commodities to the fair price shop of the petitioner to distribute to the cardholders. It is needless to mention that, so long as the authorization of the petitioner is in force, he is entitled for supply of stock.
However, learned Government Pleader for Civil Supplies has not produced any evidence to show that the petitioner's authorization was suspended, and any action was taken against him. In the circumstances, the Writ Petition is disposed of directing the respondents to supply stock to the petitioner for distribution to the cardholders so long as his authorization is in force.
