When the matter is taken up for hearing, it is noticed that the writ petition against the 1st respondent-workman was dismissed for default vide order dated 18.08.2010 and thereafter the petitioner has not taken any steps to see that the writ petition against the 1st respondent-workman, is restored. This writ petition is filed challenging the orders passed by the authority invoking the provisions of Shops and Establishments Act,1948, which were passed in favour of the 1st respondent. In the absence of the 1st respondent, this writ petition cannot be adjudicated on merits.

Accordingly, the writ petition is dismissed. No order as to costs.
