HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.18805 OF 2018 O R D E R :

This petition is filed for a writ of Mandamus declaring the action of respondent Nos.2 to 4 in trying to arrest the petitioners pursuant to the Crime No.89 of 2018 and separate the petitioners from their marital tie by violating the fundamental rights guaranteed under the Constitution of India.

Heard both sides.

Learned Assistant Government Pleader for Home submits that petitioners have alternate remedy of approaching concerned criminal court.

Learned Counsel for the petitioners could not dispute the same.

Since petitioners have alternate remedy to approach appropriate criminal court for obtaining bail, this Court is not inclined to entertain the writ petition. Accordingly, the writ petition is dismissed as misconceived. Since petitioners counsel states petitioners want to surrender before the concerned criminal court, it is left open to the petitioners to surrender before appropriate Court. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
