THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 15412 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

2. This writ petition is disposed of with the consent of both parties at the admission stage.

3. The petitioner was appointed as Fair Price Shop Dealer of Shop No.27 of Chetla Thimmaipally Village, Chegunta Mandal, Medak District. The authorization of the petitioner is valid up to 31.03.2016. Initially, the Sarpanch, Upa Sarpanch and other villagers of the village lodged a complaint against the petitioner stating that he is involved in clandestine business of weighing less quantity of essential commodities and deceiving the cardholders. The Tahsildar, Chegunta Mandal, submitted a report on 19.01.2015. Based on which, a show cause notice was issued to the petitioner by the 2nd respondent on 05.03.2015. Later on, the petitioner submitted his explanation on 18.03.2015. After receiving the explanation, the 3rd respondent addressed a letter to the 2nd respondent stating that the dealer was not committing any irregularities.

Thereafter, the 2nd respondent did not take action. As stated above, the authorization of the petitioner is subsisting as on today. But the present writ petition is filed on the ground that the petitioner is not supplied the essential commodities for distribution, even though his authorization is subsisting. In the circumstances, when the authorization of the petitioner is subsisting, the respondents 2 and 3 should have distributed the essential commodities not to cause inconvenience to the cardholders. The writ petition is disposed of directing the respondents 2 and 3 to supply the essential commodities to the petitioner as per rules. However, this will not prevent the 2nd respondent from completing the enquiry pursuant to the show cause notice dated 05.03.2015. If the 2nd respondent considers that the letter dated 19.03.

respondent is proper, he is also at liberty to drop further proceedings.

4. The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 3rd June, 2015 Note: Furnish C.C. in two days.
