ORDER: (per the Hon' ble Sri Justice C.V. Nagarjuna Reddy) This Writ Petition is filed for the following substantive relief: "....to issue a order or direction more particularly one in the nature of "Writ of Habeas Corpus" directing the Respondents, more particularly the 5th respondent to produce petitioner's minor children viz., Ayush Singh, aged about 3 years and Kumari Khushi, aged about 2 years declaring the action of the Respondents herein particularly, the 5th Respondent herein in detaining petitioner's minor children viz., Ayush Singh, aged about 3 years and Kumari Khushi, aged about 2 years as illegal, arbitrary and in violation of Articles 14, 15, 19 and 21 of the Constitution of India and pass necessary orders in the interest of justice."
In pursuance of the directions issued by this Court, the two minor children are produced by respondent No.5 and also the 2nd respondent-wife of the petitioner, who is no other than the junior maternal aunt of the minor children. The petitioner's wife informed the Court that she is presently residing with her father-respondent No.5 and also looking after the two minor children.
In the light of these facts, the learned counsel for the petitioner requests for permission to withdraw the Writ Petition, with liberty to the petitioner to avail appropriate legal remedies for claiming custody of the two minor children.
This Writ Petition is, accordingly, dismissed as withdrawn, with liberty to the petitioner as prayed for.
