THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.11917 of 2015 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the Notification vide proceedings Rc.No.A7/556/2015, dated 01.04.2015, issued by the third respondent insofar as Shop No.23 of Konduru Village, Nandigama Mandal, Krishna District, without considering the representation of the petitioner, dated 15.01.2015 for his appointment as fair price shop dealer to the above shop as illegal and arbitrary, and consequently direct the respondents 2 to 4 to consider the representation of the petitioner, dated 05.01.2015 for his appointment for the above stated fair price shop.

Heard and perused the records.

Learned counsel for the petitioner submits that the petitioner is the only breadwinner in his family and that without considering his representation, the respondents have issued Notification for appointment of fair price shop dealer. He submits that the action of the respondents in issuing Notification is illegal and as such, liable to be set aside. On hearing the learned counsel on both sides, the writ petition is disposed of with a direction to the respondents to consider the case of the petitioner for appointment as Fair Price Shop Dealer for shop No.23 of Konduru Village, Nandigama Mandal, Krishna District, on sympathetic grounds as he is the only breadwinner in his family and pass appropriate orders on his representation, dated 05.01.2015, preferably within a period of two weeks from the date of receipt of copy of this order. The writ petition is accordingly disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions, if any shall also stand disposed of.
