This civil revision petition is filed questioning order dt.14.09.2009 in E.A. No.63 of 2009 in E.P. No.23 of 2004 on the file the Junior Civil Judge, V. Madugula, Visakhapatnam District.
At the hearing, there is no representation for the petitioner. A perusal of the record shows that the order questioned in this revision petition was passed on 14.09.2009, the civil revision petition was filed on 23.01.2010 and the same has been numbered on 08.02.2017. The order assailed in this revision petition pertains to allowing of execution application filed by the respondent auction purchaser for delivery of the property purchased in a Court auction in execution of the decree. It is evident from the perusal of the proceedings sheet that no interim order has been granted in this revision petition. As the order questioned in this revision petition was passed as far back as 14.09.2009 and in the absence of interim stay all these years, it is reasonable to presume that delivery of the property must have been effected in pursuance of the order under revision.
In the light of the above facts, the civil revision petition is dismissed for non-prosecution as well as infructuous. As a sequel to dismissal of the civil revision petition, C.R.P.M.P.
