THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.28567 of 2015 ORDER:
The petitioner was appointed as a fair price shop dealer of shop No.8, Medipally Village, Yacharam Mandal in Ranga Reddy District. While so, on 19.08.2015 the Deputy Tahsildar (Enforcement) inspected the shop and found that the shop was closed. The dealer was contacted over phone when she went for Godavari Pushkaralu. When the shop was opened in the presence of mediators and panchas, it was found that there was variation in the stock. On that basis, a show cause notice was issued on 25.08.2015 and the authorisation of the petitioner was suspended on the same day. Challenging the same, the present Writ Petition is filed.
The allegation in the show cause notice relates to variation in the quantities of five items. There are other charges also relating to nonmaintenance of records and non-maintenance of timings. But, in view of the variation in quantities, this Court is not inclined to interfere with the enquiry process at this stage. However, the third respondent is directed to complete the enquiry by giving due opportunity to the petitioner, and pass final orders thereon, within a period of ninety days from the date of receipt of a copy of this order.
The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
