HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.18753 of 2013 ORDER:

There is no representation on behalf of the petitioner. The prayer sought in the writ petition is as under: " For the reasons stated in the accompanying affidavit, it is hereby prayed that this Court may be pleased to issue an appropriate writ order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action on the part of the respondents 2 and 3 herein in threatening the petitioner to pay Rs.3,00,000=00 to the 4th respondent towards the loss sustained by him by calling the petitioner to the police station every day as illegal arbitrary and unconstitutional and without authority of law and consequently direct the respondents 2 and 3 not to call the petitioner to the police station particularly at the behest of 4th respondent in the interest of justice and to pass such other order or orders as this Hon'ble Court may deems fit and proper in the circumstances of the case."

The basic grievance of the petitioner is that the respondents 2 and 3, without any authority in law, are threatening the petitioner to pay Rs.3 lakhs to the 4th respondent towards loss sustained by him by calling him to the police station everyday. Learned Government Pleader appearing for the respondents 1 and 2 placed on record the written instructions dated 9.7.2013 issued by the Station House Officer, Jeedimetla Police Station, Cyberabad.

The perusal of the said written instructions indicate that basing on a complaint, Crime No.295 of 2013 for the offences under Sections 406, 408, 417, 418, 420 IPC has been registered on 15.4.2013 against the petitioner ad investigation has been taken up. When

the petitioner presence was required for the purpose of investigation, instead of c o-operating with the investigating agency, the present writ petition has been filed with false allegations. In fact, except registering the above said crime, the respondent-police never harassed, threatened or interfered with the civil disputes between the petitioner and the 4th respondent. In view of the said statement, this Court is of the opinion that no further orders are required.

Accordingly, the writ petition is dismissed. There shall be no order as to costs.
