THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.24026 of 2016 O R D E R:
Petitioner has filed this Writ Petition seeking a declaration that respondents 5 and 6 have created a fabricated complaint allegedly made by the 7th respondent and filed an FIR No.106 of 2016 on 06.07.2016 before Mominpet Police Station of Ranga Reddy District alleging that the petitioner's son had committed an offence under Section 379 IPC, Section 3 of PDPP Act and Section 21(4) of MMD Act, 2015, and that the son of the petitioner was involved in theft of sand.
2. Counsel for the petitioner contends that the said action has been initiated allegedly on the complaint of 7th respondent, which is fabricated, and therefore action should be taken against respondents 5 ands 6 in that regard.
3. The matter is at the stage of FIR only and would be investigated and later final report would be filed before the Judicial First Class Magistrate, Vikarabad, Ranga Reddy District.
4. At this stage, it is not possible to come to any conclusion whether the complaint of the 7th respondent against the petitioner's son is fabricated or not. Therefore, I am not inclined to grant any relief to the petitioner.
5. The Writ Petition is accordingly dismissed. There shall be no order as to costs.
6. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
