HONOURABLE SRI JUSTICE M. S. RAMACHANDRA RAO AND HONOURABLE SRI JUSTICE K. LAKSHMAN CIVIL REVISION PETITION No.2423 OF 2019 ORDER: (Per Hon'ble Sri Justice M.S. Ramachandra Rao) This revision petition is filed challenging the order dated 02.08.2019 in I.A. No.683 of 2019 in Arbitration O.P. No.77 of 2019 on the file of the XI Additional Chief Judge, City Civil Court, Hyderabad, granting interim stay of execution of the Arbitral Award dated 15.05.2019 passed by the 2nd respondent on condition of the petitioners depositing 50% of the awarded amount by 16th September, 2019.
2. Though the counsel for the petitioners sought to contend that the award is illegal and the Court below did not take into account the relevant factors in passing the conditional order against the petitioners, since the impugned order is a discretionary order and since only 50% of the awarded amount has been directed to be deposited by the petitioners, we do not see any error of jurisdiction in the said order warranting interference by this Court under Article 226 of the Constitution of India. Accordingly, the writ petition fails and is dismissed.
No order as to costs. As a sequel, miscellaneous petitions, if any pending, shall stand dismissed.
