Maheshwara Educational Society, v. The Govt Of Telangana
IN THE HIGH COURT OF JUDICATURE AT HYDERABAD
FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (SPECIAL ORIGINAL JURISDICTION) THURSDAY, THE NINETEENTH DAY OF MARCH TWO THOUSAND AND FIFTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION Nos.18843, 2380 and 15564 of 2014 BETWEEN Maheswara Educational Society and others ... PETITIONERS AND The Government of Telangana, Rep. by its Principal Secretary, Higher Education Department, Secretariat, Hyderabad and others. ...RESPONDENTS The Court made the following:
COMMON ORDER:
The issue involved in these writ petitions is already considered by this court in W.P.Nos.6308 and 9441 of 2014 and the same were dismissed on 10.02.2015 following the ratio of the Full Bench Judgment of this Court in [1] Society of St.Ann's v. Secretary to Government (Edn.)
2. Though, on facts, learned counsel for the petitioner makes slight distinction from that case and the present case on the ground that here the competent authority has granted permission and not the Government, I do not think that the said distinction has a material effect on the ultimate analysis. Moreover, the impugned proceedings is dated 12.06.2014 and there was no interim order in this writ petition since 09.07.2014 and respondent No.4-college, which is represented by learned counsel, is stated to be already functioning since last two academic years with enrollment of 164 students, most of whom are stated to be appearing for examinations now.
In view of that, the writ petitions are dismissed. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
