Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue.
The grievance of the petitioner is limited to the extent of not conducting enquiry by the 4th respondent, in spite of issuance of notice proposing to conduct enquiry vide Rc.No.B/181/14, dated 08-07-2014.
The petitioner states that he is a physically challenged person and he is the son of the late Thakur Ganga Singh. He states that his father was allotted the land admeasuring Ac.5-00 gts., in Sy.No.176/E situated at Gangipalli Sivaru, Jaipur Mandal, Adilabad District. It is alleged that his younger brother i.e., 6th respondent obtained mutation in his favour in respect of the aforesaid land. The petitioner stated to have given complaint against the 6th respondent, based on which, the 4th respondent proposed to conduct an enquiry and accordingly issued aforesaid notice to the petitioner as well as the 6th respondent. However, alleging that no further action is taken by the 4th respondent, the present writ petition is filed. Keeping in view the grievance of the petitioner, the learned Government Pleader was asked to get instructions.
However, the learned Government Pleader reports that since the 4th respondent had already issued notice proposing to conduct enquiry, he shall hear the parties and appropriate enquiry would be conducted. The writ petition is, therefore, disposed of directing the 4th respondent to hear the petitioner as well as respondents 5 and 6 and complete the enquiry as proposed in the notice referred to above and pass appropriate orders expeditiously, preferably within two months from the date of receipt of a copy of this order. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
