THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.10200 of 2016 ORDER:
Petitioner's vehicle bearing registration No.AP 10 W 5809 is stated to have been seized by the 3rd respondent on 09.02.2016 under Check Report No.2698898, dated 09.02.2016. Petitioner, however, seeks release of the said vehicle by its petition 23.02.2016 sent to the 2nd respondent. Petitioner has approached this Court seeking release of the said vehicle.
Since the petitioner has already filed the requisite application, this Court deems it appropriate to dispose of the writ petition by directing the 2nd respondent to consider the petition of the petitioner and pass appropriate orders. It is made clear that the Deputy Transport Commissioner may impose appropriate conditions, as deemed fit in the event he permits release of the vehicle to the petitioner. Duly keeping in view the ratio of the Division Bench judgment of this Court in Saleem Tours and Travels v. Joint Transport Commissioner and Secretary, RTA, Hyderabad[1], the 2nd respondent shall pass appropriate orders within three (3) days from the date of receipt of a copy of this order.
The writ petition is disposed of.
