HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No. 6375 of 2002 O R D E R:- This writ petition is filed seeking to issue a writ of Mandamus declaring Note(2) of Part-III, Class-III, Cat.(1) of APSEB Service Regulation, as illegal, arbitrary and ultravires and set aside the same. A consequential direction to the respondents to promote the petitioner as Junior Accounts Officer is also sought.

Heard Sri K.Vasudeva Reddy, learned counsel for the petitioner and Smt.A.Deepti, learned Standing Counsel for A.P.C.P.D.C.L. for the respondents.

When the matter is taken up for hearing, it is reported by the learned Standing Counsel that the petitioner has retired from services, as such, the cause in this writ petition no longer survives and the matter has become infructuous. In view of the above submission, the writ petition is dismissed as infructuous. No order as to costs. As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
