THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13039 OF 2016 ORDER:

This petition is filed by the petitioners-accused Nos.1 to 10 under Section 482 Cr.P.C. seeking to quash the proceedings against them in C.C.No.277 of 2016 on the file of the Additional Judicial Magistrate of First Class, Srikakulam.

Heard and perused the material available on record. The petitioners are alleged to have committed the offence punishable under Sections 498-A IPC and Section 4 of the Dowry Prohibition Act. The 2nd respondent is the wife of A1. A2 to A10 are the relatives of A1.

Learned Counsel for the petitioners submitted that the petitioners are nothing to do with the alleged offence and that the petitioners were falsely implicated in the above crime.

Learned Additional Public Prosecutor opposed this petition. The truth or otherwise of the allegations can be decided after full fledged trial. Therefore, this Court is not inclined to grant the relief sought by the petitioners.

At this stage, the learned Counsel for the petitioners prayed for dispensing with the presence of the petitioners before the trial Court. In view of the above submission, the presence of the petitioners before the trial Court is dispensed with except on the dates when their presence is specifically required by the trial Court. The petitioners are

directed to be represented through a Counsel before the trial Court on all hearing dates.

Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. ______________________ JUSTICE RAJA ELANGO Date : 2.9.2016 Nn
