HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.16320 OF 2002 ORDER:

When this matter is taken up for hearing, the learned Counsel for the petitioner submitted that the issue raised in this writ petition is squarely covered by the judgment rendered by the Hon'ble Division Bench of this Court in W.P.No.3460 of 2010 and batch, dated 23.8.2017. The learned Government Pleader for Higher Education has not disputed the same. Recording the above submission, the Writ Petition is disposed of directing the 3rd respondent to submit proposals to the competent authority for counting unaided service of the petitioner for the purpose of pensionary benefits. On such proposals being submitted by the 3rd respondent, the competent authority shall consider the same and pass appropriate orders in accordance with the judgment of the Hon'ble Division Bench of this Court in W.P.No.3460 of 2010 and batch, dated 23.8.2017, within a period of four weeks thereafter. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
