HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19800 OF 2018 O R D E R :

This writ petition is filed challenging the proceedings dated 11.05.2018 issued by the 3rd respondent rejecting the representation of the petitioner dated 24.02.2018 and 06.04.2018 holding as follows;

"In response to the petition applied, this office deems that issue related to the petitioner and V.Linga Swamy (5th respondent) and B.Satyanarayana (6th respondent) is civil in nature. Hence, there is no relation between Port Authorities and the petitioner and other parties regarding this dispute is concerned. The petitioner cannot direct the Port Department to stop issuing the Port clearance which is permitted by law and other procedures. The Port Department will not entertain such type of disputes."

Heard learned counsel for the petitioner and learned Standing Counsel appearing for respondents 1 to 3. A reading of the affidavit and impugned order goes to show that a civil dispute is pending between the petitioner and unofficial respondents and holding the same the authorities rightly rejected the representation of the petitioner by way of impugned order. More so, this Court cannot decide the disputed questions of fact. In view of the same, I do not see any reason to entertain the writ petition.

Accordingly the writ petition is dismissed. However, it is open for the petitioner to avail alternate remedy as may be available to his under law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 21.06.2018 t k.
