Subhash Reddy) This Civil Miscellaneous Appeal is filed by the appellant - plaintiff in O.S. No.

2 of 2014 on the file of X Additional District and Sessions Judge, Visakhapatnam at Anakapalle (for short 'trial Court'), aggrieved of the order and decree, dated 21-08-2014, in I.A. No.142 of 2014 in O.S. No.2 of 2014. 2. The aforesaid suit is filed by the appellant - plaintiff for specific performance of agreement of sale, dated 28-12-2013. It is alleged by the appellant that the respondent is the owner of property, ad measuring Ac.0.80 cents in Sy.No.20/2, situated at Thimmarajupeta village in Munagapaka Mandal, Visakhapatnam District, and she entered into an agreement of sale with the appellant to sell the said property for total consideration of Rs.32,00,000/- (Rupees thirty two lakhs only). On the same day, the appellant herein has paid Rs.

20,00,000/-(Rupees twenty lakhs only) to the respondent herein towards advance and, in spite of the demand made by the appellant, the respondent refused to execute registered sale deed to convey the suit schedule property. Hence, the appellant filed O.S. No.2 of 2014 against the respondent seeking specific performance of the agreement of sale. 3. Along with the suit, the appellant - plaintiff filed I.A.142 of 2014 under Order 39, Rules 1 to 3 and Sections 94 and 151 of the Code of Civil Procedure 1908, seeking temporary injunction, restraining the respondent herein from alienating the suit schedule property in favour of third parties by way of sale, mortgage, lease, agreement and gift deed or in any mode of conveyance during the pendency of suit. 4.

In the said interlocutory application, the respondent - defendant filed counter denying the claim of the petitioner. It is mainly alleged by the respondent - defendant that the appellant conveniently changed the second page of the agreement of sale and inserted another page by forging her signature, and also suppressed the receipt of legal notice, dated 03-03-2014, got issued by her to the appellant and, as such, the appellant is not entitled for the relief of injunction. 5. The trial Court, having considered the contents of the affidavit, the counter affidavit and the documentary evidence, more particularly, Ex.

P-1, agreement of sale, prima facie, came to the conclusion that the signatures on the first and third page of the agreement of sale are one and the same, but the font of the letters on second page are in variance to that of the font of the letters on the first and third page. By entertaining a doubt, prima facie, with regard to the genuineness or otherwise of the agreement of sale, the trial Court dismissed the petition, by order, dated 21-08-2014. 6. Aggrieved by the order, dated 21-08-2014, in I.A. No.142 of 2014 in O.S. No.2 of 2014, passed by the trial Court, the plaintiff preferred the instant appeal. 7. Heard Ms.T.V. Sridevi, learned counsel for the appellant and perused the material on record. 8.

On perusal of record, it is clear that since last about ten (10) months, there is no temporary injunction in favour of the appellant, and even, there was no interim injunction granted by the trial Court before dismissal of the petition. Although it is contended by the learned counsel for the appellant that the agreement of sale is not forged and the same was executed by the respondent on receipt of Rs.20,00,000/- (Rupees twenty lakhs only) towards advance out of total sale consideration of Rs.32,00,000/-, in view of the observations made by the trial Court, prima-facie, it appears, that the font of the letters in the second page of the agreement of sale is in variance to that of the font of the letters on the first and third page.

In that view of the matter and also keeping in view the defence taken by the respondent that the agreement of sale is tampered by inserting the second page, prima-facie, the appellant has not made out any case for grant of temporary injunction, as prayed for. It is true, that finding, as to whether the second page of the agreement of sale is tampered or not, is to be recorded by the trial Court only after fullfledged trial, but at the same time, we do not find any grounds to interfere with the order of the trial Court. 10. The Civil Miscellaneous Appeal is devoid of merits and is accordingly dismissed. However, we direct the trial Court to dispose of the main suit, as expeditiously as possible, on merits, uninfluenced by the observations, if any, made by this Court. No order as to costs. 11.
