THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.9211 of 2017 ORDER:

Petitioner was retired on medical invalidation ground as Driver. He was provided alternative employment as Shramik. Petitioner seeks pay and allowances as applicable to the post of Driver in the post of Shramik from 15.02.2016. Petitioner submitted representation on 15.02.2016 to the Regional Manager (2nd respondent) to grant him pay protection of the post of Driver till he attains the age of superannuation. Alleging inaction on the said representation, this Writ Petition is filed.

Since the representation submitted by the petitioner is pending consideration, I am not inclined to keep this writ petition pending.

Therefore, this Writ Petition is disposed of directing the 2nd respondent to examine the claim of the petitioner as ventilated in his representation dt.15.02.2016 and pass appropriate orders as warranted by law by assigning due reasons in support of the decision and communicate the same to the petitioner within a period of six (06) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
