S.P.Eswar Rao Business Sec.Bad v. P.Bhaksrara Murhty Hydand 6 ORS
THE HON'BLE SRI JUSTICE A.VENKATESHWARA REDDY CIVIL REVISION PETITION NO.2183 of 2003 ORDER:
None appears on behalf of the revision petitioners. It may be stated that when the matter was initially called Ms. Sudeepthi, Advocate has requested for an adjournment. But, having regard to the proceedings dated 18.10.2022, since the Civil Revision Petition is directed to be listed under the caption "for dismissal", it was kept aside and again called at 12.20 p.m, there is no representation on behalf of the revision petitioner. Perused the proceedings dated 27.02.2020 wherein it is mentioned that the sole revision petitioner passed away long back and requested for short time. But, till date no steps are taken to bring the legal representations of sole revision petitioner. Accordingly, today the civil revision petition is listed under the caption "for dismissal".
Hence, presence or representation on behalf of revision petitioner is felt essential. In the absence of proper representation having regard to the fact that the civil revision petition is pending more than twenty years, I do not find any merits to adjourn the matter. Accordingly, Civil Revision Petition is dismissed for default for non-prosecution.
there shall be no order as to the costs. Miscellaneous applications, if any pending, shall stands closed. ________________________________ A.VENKATESWHARA REDDY, J 26-10-2022 PL
