Jagruti Institute Of Engineering And Technology, v. State Of Telangana, Rep. By Its Principal Secretary,
HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.1346 of 2015 ORDER:
Heard.
In this writ petition, the grievance of the petitioner is that the 3rd respondent has rejected the approval with respect to spot admissions made by the petitioner's institution and the list of candidates, whose admissions are rejected, shows that it was rejected on the ground that the students, who were admitted, belong to other States. The very similar aspect was considered by this Court in W.P.No.32797 of 2014 and batch, which was allowed on 31-10-2014.
Sri A.Abhisekh Reddy, learned counsel appearing for R3 fairly states that the issue, as adjudicated by this Court in W.P.No.24581 of 2009 and batch, dated 20-11-2009 has attained finality. In view of that, following the same ratio, W.P.No.32797 of 2014 and batch was allowed on 31-10-2014.
In view of the same, this writ petition is allowed in terms of W.P.No.32797 of 2014 and batch, dated 31-10-2014, which are as follows:- "The impugned proceeding so far as it relates to rejection of candidature of students admitted by the petitioners respectively only on the ground that they belong to other States shall stand set aside subject to the condition that the admitted students are eligible for admission and qualified for that. The Convenor shall, therefore, re-examine the matter and pass appropriate orders expeditiously preferably within two weeks from the date of receipt of a copy of this order, in the light of directions of this Court, referred to above.
No order as to costs.
The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
