THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO TRANSFER CIVIL MISCELLANEOUS PETITION NO.336 OF 2018 ORDER:

This Transfer Civil Miscellaneous Petition is filed under Section 24 CPC seeking to transfer F.C.O.P.No.4 of 2018 on the file of the Family Judge-cum-VII Addl. District and Sessions Judge, Medak, Sangareddy, to the Court of Additional Family Judge, Nampally, Hyderabad, to be tried along with M.C.No.140 of 2018 pending on the file of the said Court.

Though notice in the Transfer C.M.P. was served and one Sri B.Shyam, learned counsel has filed vakalat, he has not appeared before this Court today.

According to the petitioner, she is the wife of the respondent. She is seeking transfer on the ground that she is finding it difficult to attend the Court at Sanga Reddy. She has a daughter, who is a student getting educated in a school in Anand Nagar, Khairatabad, Hyderabad and it would be more convenient for her if the matter is transferred to the Additional Family Court, Nampally, Hyderabad. 4.

No valid ground is furnished in the counter filed by the respondent not to accede to the request of the petitioner.

Therefore, the Transfer Civil Miscellaneous Petition is allowed. F.C.O.P.No.4 of 2018 on the file of the Family Judge-cum-VII Addl. District and Sessions Judge, Medak, Sangareddy, is transferred to the Court of Additional Family Judge, Nampally, Hyderabad, to be tried along with M.C.No.140 of 2018 pending there. No order as to costs.

Miscellaneous petitions, if any pending in this petition shall stand closed.
