ORDER

This criminal petition under sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner-A32 seeking bail in Cr.No.102 of 2015 of Chennur Police Station, Kadapa District, registered for the offences punishable under Sections 379, 307, 353, 120(B) read with Section 109 IPC and under Section 20(1)(c)(x) of A.P.Forest Act, 1967 Rule 3 of A.P.Sandal Wood and Red Sanders Wood Transit Rules, 1967, Sections 29 & 68 of A.P.Forest Act, 1967 r/w.Sec.29(4) of A.P.Forest Act, 1967 and under Section 3 of PDPP Act and Section 51 of Wild Life Protection Act.

2. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor.

It is alleged that on 24.08.2015 at 02.00 PM., on credible information, the complainant along with Anti-red sander smuggling task force officers arrested A1 to A5, who were illegally transporting the red sander logs and who made an attempt against the police party by hitting with their vehicles, pelting stones and attacking with iron rods and they seized 139 red sander logs, 1 tanker, 3 cars, cash and mobile phones under cover of panchanama , and on interrogation, A1 to A5 revealed the names of A6 to A32.

4. Learned counsel for the petitioner/A32 contended that based on the confession of the co-accused only, the petitioner's name was implicated in this case.

5. The petitioner was arrested on 20.09.2015. Since the confession of co-accused is relevant for the purpose of investigation, this Court is not inclined to grant bail to the petitioner at this stage.
