Heard Mr.Naram Nageswara Rao for petitioner in W.P.No.20126 of 2016, Mr.B.Sesibhushan for petitioner in W.P.No.43253 of 2016 and the Assistant Government Pleader (Land Acquisition).
The petitioners in these writ petitions complain against either granting or not granting compensation for acquiring land in an extent of Ac.2-18 cents in R.S.No.31/ 1 and Ac.2-03 cents in R.S.No.31/ 2 of Singanapalli Village, Polavaram Mandal, West Godavari District.
The claim relates to award of compensation exclusively to petitioners in these writ petitions. The Assistant Government Pleader has placed on record the written instructions dated 15.12.2016. I have perused the written instructions, and I am of the view that the grievance now complained in these writ petitions, at the first instance is to be considered and decided by the Special Deputy Collector/ respondent No.3 after hearing the parties herein and not for this Court to adjudicate the claims in these writ petitions. Hence the writ petitions are disposed of by this order: (i) The petitioners in both the writ petitions are given liberty to file representation/ explanation together with documents in support
of their respective claim(s) for grant of compensation along with this order.
The Special Deputy Collector/ 3rd respondent issues notices to both the petitioners, opportunity of hearing is provided and decides entitlement or payment of compensation within four weeks thereafter.
The writ petitions are disposed of accordingly. No order as to costs.
