THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO CIVIL REVISION PETITION No.2416 of 2015 ORDER:

Sri R.Dheeraj Singh, learned counsel for the petitioner, would submit that as a matter of principle the petitioner/plaintiff preferred this revision as the respondent has not filed the written statement, in spite of receiving the summons in this case, within time. But yet the Court below has condoned the lapse and allowed the written statement.

When it was pointedly drawn his attention to the fact that the suit is one for declaration of title and it would be appropriate that the same should be allowed to be decreed upon contest, Sri R.Dheeeraj Singh, learned counsel for the petitioner, advisedly seeks permission of the Court to withdraw the revision. Permission is accorded.

Accordingly, the civil revision petition is dismissed as withdrawn. No costs. The miscellaneous petitions, if any, pending in this revision shall stand closed.

I only hope that the Court below will bestow its attention for the speedy disposal of the suit.
