As there was no representation for the appellant on 10.12.2015, the matter was directed to be listed under the caption "FOR DISMISSAL" on 22.06.2016. Again, when the matter came up on 22.06.2016 under the caption "FOR DISMISSAL", at request of learned counsel for the appellant, the matter was directed to be listed on 23.06.2016 by removing from the caption "FOR DISMISSAL". Again when the matter was listed on 24.06.2016, as there was no representation for the appellant, the matter was directed to be listed next week under the caption "FOR DISMISSAL".

2. Even today, despite the matter being listed under the caption "FOR DISMISSAL", there is no representation for the appellant. It appears that the appellant is not interested in pursuing the matter.

3. Accordingly, the Civil Miscellaneous Appeal is dismissed for non-prosecution. Interim stay granted by this Court on 10.08.2005 is vacated. As a sequel, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
