At the time when the matter is taken up for hearing, learned counsel for the petitioner seeks permission to withdraw the writ petition with a liberty to file an appeal before the Commissioner. Permission as sought for is accorded.

Accordingly, the Writ Petition is dismissed as withdrawn giving liberty to file an appeal before the Commissioner. In case the appeal is filed, the same shall be considered on merits.
