HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.19103 of 2018 ORDER:

Heard Mr.M.Damodar Reddy, counsel for the petitioner and the Assistant Government Pleader for Revenue for the respondents. 2.

The petitioner challenges the alleged interference of respondents with the construction of house bearing No.6-2108/A1 (Old No.6-2-109/1), measuring 130 square yards in Survey No.535 of Kotha Bazar, Mahabubabad Town, as illegal and unconstitutional.

The Assistant Government Pleader, by referring to written instructions, states that by referring to Survey No.535, the petitioner is constructing house in Government land (Mathruka property). Therefore, to prevent change of physical features, the petitioner was prevented from proceeding with the construction. 4.

Mr.M.Damodar Reddy objects to the stand taken by the 4th respondent and states that the 4th respondent, if conducts survey in the presence of petitioner and identifies the Government land and the property claimed by the petitioner in Survey No.535, such exercise gives quietus to the grievance of the petitioner and thereafter, the 4th respondent cannot also interfere in the possession and enjoyment of petitioner. The request now is confined to directing the 4th respondent to conduct survey of Government land and the property claimed by the petitioner. 5.

After hearing the counsel for the petitioner and perusing the record, the Writ Petition is disposed of as follows:

>>2<< SVB, J W.P.No.19103 of 2018 'The petitioner applies to the 4th respondent online for survey and demarcation by paying necessary fee within two (02) weeks from the date of receipt of a copy of this order. The petitioner submits the hard copy of the online application and the copy of this order to the 4th respondent within one (01) week thereafter. The 4th respondent, within four (04) weeks from the date of receipt of the hard copy, undertakes survey and demarcation of Government land and the property claimed by the petitioner. The 4th respondent furnishes a copy of the report to the petitioner for further steps, if any.'

No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
