THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.21052 OF 2016 ORDER:

Heard the learned counsel for the petitioner and Sri N.Ashok Kumar, learned Government Pleader for Roads and Buildings, for respondents. With consent of the counsel appearing for both sides, the present writ petition is disposed of at the admission stage.

2. The present writ petition came to be filed with the following prayer:

"to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus, or any other appropriate writ, order or direction, declaring the inaction of the respondents in considering the petitioner's Representations dated 28.11.2015 made to the 3rd respondent and 14.04.2016 made to the 2nd respondent requesting them either to compensate the losses sustained by the petitioner under the Agreement SE/LS/AGRT No.84/2013-14, dated 01.03.2014 by foreclosing the same and refunding the EMD or grant new work i.e., widening and strengthening of road from 2 lane to 6 lane from Kms 140/5 to 146/850 Rayapatnam - Kodada Rao, Warangal District with the prevailing SSR rates 2016, as illegal and arbitrary and further direct the respondents to consider the Representations dated 28.11.2015 & 14.04.2016 made by the petitioner and pass such other order or orders as may deem fit and proper in the circumstances of the case."

3. Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to respondents 2 and 3 to consider and dispose of the representations dated 28.11.2015 and 14.04.2016 at the earliest.

4. Learned Government Pleader for Roads and Buildings did not dispute the same.

5. Having regard to the circumstances of the case and without going into the merits of the case, the Writ Petition is disposed of directing respondents 2 and 3 to consider the representations dated 28.11.2015 and 14.04.2016, in accordance with law, as early as possible, preferably within a period of three (03) weeks from the date of receipt of a copy of this order.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
