HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No.8551 OF 2010 ORDER:

The relief sought for, in this Writ Petition, is to declare the action of the respondent in allotting shops 10 to 17, constructed in the Pithapuram Vegetable market, by way of private negotiations without conducting public auction, as arbitrary and illegal. By way of an interim order, in WPMP No.11002 of 2010 in W.P. No.8551 of 2010 dated 22.04.2010, this Court had directed the respondent not to allot the subject shops, except after putting the leasehold rights of the shops to public auction. As there is no provision in the Rules for private negotiations, and as a reasonable and transparent mode of auction of the leasehold rights of shops is by way of public auction, I consider it appropriate to dispose of the Writ Petition directing the respondent not to grant leasehold rights of the shops, belonging to the Municipality, except by way of public auction. The Writ Petition stands disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed.
