HON'BLE SRI JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 11438 OF 1999 ORDER: (per the Hon'ble Sri Justice Dilip B. Bhosale) This writ petition was called out on 05-02-2015 and since none appeared for the parties, it was adjourned to today "for dismissal".

Learned advocates who are on record for the petitioners state that the petitioners took away papers from them long back and they have no instructions to appear in the petition. Mr. V.Gopal Krishna Gokhalay, learned counsel for respondent No.1 submits that the question raised in the writ petition is squarely covered by the judgment in Tijiya Steel (P) Ltd. Vs. Commissioner of C.E., Haldia[1]. We would not like to examine the matter on merits, since none represents the petitioners. Hence, the writ petition is dismissed for non-prosecution. Consequently, miscellaneous petitions, if any, also stand disposed of. No costs.
