THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.19104 of 2018 ORDER:

Heard the learned counsel for petitioner, learned Government Pleader for Panchayat Raj appearing for respondent Nos.1 to 4 and Sri G.V.S. Mehar Kumar, learned counsel for 5th respondent/caveator. 2.

Petitioner's grievance is that petitioner had assailed the order dt.05-05-2018 passed by the District Collector, Guntur District vide proceedings Roc.No.275/2018 G3 in appeal preferred before the 1st respondent on 25-05-2018 along with suspension application and that the 1st respondent has not taken up the appeal or suspension application till date.

Learned counsel for petitioner contends that the term of the petitioner as Sarpanch itself would expire on 27-07-2018 and appeal would be rendered as infructuous, if not taken urgently. 4.

Learned Government Pleader for Panchayat Raj appearing for respondent Nos.1 to 4 states that the 1st respondent will decide the appeal within three weeks.

Learned counsel for 5th respondent has no objection to this course of action.

Accordingly, the Writ Petition is disposed of directing the 1st respondent to decide the appeal preferred by petitioner challenging

MSR,J W.P.No.19104 of 2018 the order dt.05-05-2018 passed by the 2nd respondent, within three

(03) weeks and communicate his decision to the petitioner. No costs. 7.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
