THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.4173 of 2017 ORDER:

This Writ Petition is disposed of at the stage of admission after hearing the learned Government Pleader and the learned Counsel for the petitioner.

The petitioner is the owner of a tractor bearing registration No.TS 07 UC 6785 along with trolley bearing No.TS 07 UC 6801. When the said vehicle was transporting sand on tractor via Marepally Village, the complainant of FIR No.14 of 2017 reported to the Police. Thereupon, the second respondent seized the vehicle. Learned Counsel for the petitioner submits that as per G.O.Ms.No.15, dated 19.02.2015, the vehicle should not have been seized, if the petitioner is willing to pay the penalty indicated in the said Government Order.

In the circumstances, the second respondent is directed to follow G.O.Ms.No.3, dated 08.01.2015, as amended by G.O.Ms.No.15, Industries and Commerce (Mines-I) Department, dated 19.02.2015, and take further action, within a period of one week from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of.
