THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.8534 of 2004 ORDER:

This writ petition is filed under Article 226 of the Constitution of India to issue a writ of Mandamus by declaring the Regulation 4 of G.O.Ms.No.26- Industries & Commerce (SES) dt.29-1-1996 as illegal, arbitrary and unconstitutional and consequentially set aside the Regulation 4 in respect of promotions from the posts of Superintendents & Accountants to the post of Development Officers and Asst. Accounts Officer etc. by holding that Accountants also eligible for the post of Development Officers, Establishment Officers on par with Superintendents category.

2. The learned counsel for the petitioners submitted that the petitioners have retired from service on attaining the age of superannuation.

He further submitted that no further orders are necessary as no cause of action survives in this writ petition.
