HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.6332 OF 2019 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (Cr.P.C.), is filed by the petitioner/A-1, for grant of anticipatory bail in Crime No.104 of 2019 of Chandampet Police Station, Nalgonda District, registered for the offences punishable under Sections 409, 419, 420, 464, 465 and 468 read with Section 34 of the Indian Penal Code. Heard the learned counsel for the petitioner/A-1, the learned Additional Public Prosecutor representing the respondent-State and perused the record.
In the FIR, it is inter alia stated that on 25.09.2019 the de facto complainant lodged a complaint stating that as per the orders of superior officers i.e., the District Collector, Nalgonda and the Revenue Divisional Officer, Devarakonda, the petitioner/A-1 and six other persons illegally transferred the Government land and Forest land in Survey No.50 of Achampet Patti Village, Survey No.8 of Rekulagadda Village and Survey Nos.50 and of Kambalapally Village of Chandampet Mandal in favour of illegal pattedars and hence, he requested to take legal action against the said persons.
Learned counsel for the petitioner/A-1 would submit that the petitioner/A-1 is innocent and he has not committed any offence as alleged and the de facto complainant, without any complaint or basic evidence, addressed letter to the District Collector, Nalgonda, only on the basis of news item in 'Namaste Telangana' daily newspaper. It is further submitted that the
petitioner/A-1 has been working as a Deputy Tahsildar, Chandampet, with utmost satisfaction of his superiors without any remarks and he has been dragged into this false case. Hence, he prayed to grant anticipatory bail to the petitioner/A-1. Learned Additional Public Prosecutor representing the respondent-State opposed to grant anticipatory bail to the petitioner/A-1.
As seen from the contents of the remand case diary, there are specific allegations against the petitioner/A-1 that he along with some other persons illegally transferred the Government land and Forest land to the persons who are not eligible and entitled and issued pattas to them.
Having regard to the facts and circumstances of the case, nature and gravity of the offence and as the petitioner/A-1 along with some others involved in illegally transferring the Government land and Forest land to the persons who are not eligible and entitled, this Court is not inclined to grant anticipatory bail to the petitioner/A-1.
The Criminal Petition is, accordingly, dismissed.
