CIVIL REVISION PETITION No:2926 OF 2010 ORDER:
This revision is directed against the order, dated 29.6.2007 passed by the Andhra Pradesh Wakf Tribunal in O.A.No.20 of 2003.
The revision petitioner filed the above O.A. seeking to set aside the appointment of the 2nd respondent as Muthawalli vide proceedings No.115/H3/J1/1/92, dated 10.1.2003 and proceedings dated 8.7.2003.
The tribunal having observed that after due enquiry and publications and rejecting the claim of the applicant herein, and calling objections only, the 2nd respondent being great grand son of Nawab Syed Abdul Haq Sahab, owner and Wakif, is appointed as Muthawalli vide proceedings dated 10.1.2003 and that the applicant has also participated in the appointment proceedings, dismissed the above O.A. Hence, the present revision is filed by the petitioner.
Heard the learned Counsel and perused the material available on record.
It is the case of the petitioner-applicant that no notice was given to him before appointment of the 2nd respondent. Except
stating so, he did not adduce any material before the Tribunal in support of his contention. On a perusal of the material on record, it is obvious that the petitioner-applicant participated in the appointment proceedings and that the 1st respondent after calling objections only, appointed the 2nd respondent. Apart from that, there is also no dispute as to the publication and calling for the objections prior to the appointment of the 2nd respondent. In this background of the matter, I have no hesitation to hold that the order of the Tribunal, does not suffer from any illegality or irregularity. Hence, this revision petition is devoid of merits and the same is liable to be dismissed. Accordingly, the CRP is dismissed. No order as to costs. ________________________ Justice T.
