HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 18849 of 2016 ORDER:

Heard learned counsel for the petitioner and Sri S.Arifulla, Standing Counsel for Wakf Board.

There is no necessity to put the unofficial respondent on notice as this Court is not venturing to adjudicate the issue on merits.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.3 and 4 in not delivering the possession of shopping complex situated in 73 cents of land in T.S.No.183, Fort Ward, Visakhapatnam to the petitioner, as illegal, arbitrary and contrary to the observations made by this Court in W.P.No.16496 of and W.V.M.P.No.1805 of 2009 in W.P.No.3324 of 2009; and consequently direct the respondents to deliver the physical possession of the said shopping complex to the petitioner in terms of the proceedings Rc.No.4/VSP/PI-SC/Wakf/2004, dated 13.09.2006 of District Revenue Officer, Visakhapatnam. Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the third respondent to dispose of his representation dated 09.01.2016 at the earliest.

Without going into the merits of the case and having regard to the facts and circumstances of the case, the present writ petition is disposed of, directing the third respondent to dispose of

the representation dated 09.01.2016 made by the petitioner, in accordance with law, as expeditiously as possible, preferably within a period of three (03) weeks from the date of receipt of a copy of the order, if the same is made and still pending consideration. The third respondent also directed to issue notice to the petitioner and all the aggrieved persons and to hear them before passing orders on the representation dated 09.01.2016. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
