HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.27728 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the inaction on the part of respondents 4 and 5 in disposing of the representation of the petitioners dated 29.06.2016 as illegal and arbitrary.

Heard Sri P.Ravi Shanker, learned counsel for the petitioners and the learned Assistant Government Pleader for Cooperation (Telangana) representing the respondents 1 to 5. 3.

A perusal of the record reveals that the petitioners are the Executive Members of sixth respondent society. The grievance of the petitioners is that the respondents 7 and 8 have not convened the meeting in accordance with bye-laws. A perusal of the record reveals that the first petitioner submitted a representation to the respondents 4 and 5 on 29.06.2016. For one reason or other, respondents 4 and 5 have not disposed of the representation of the first petitioner dated 29.06.2016.

At the time of arguments, the only relief sought by the petitioners is to direct the fourth and fifth respondents to dispose of the representation of the first petitioner dated 29.06.2016. Learned Assistant Government Pleader also consented for the same.

In view of the submissions made by both the counsel, this Court is not inclined to go into the merits of the main case. 6.

Having regard to the facts and circumstances of the case and also the submissions made by both the counsel, the respondents 4 and 5 are hereby directed to dispose of the representation of the first petitioner dated 29.06.2016 as expeditiously as possible, preferably, within a period of two months from today, after affording a reasonable opportunity to the petitioner as well as the respondents 7 and 8.

With the above direction, this writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
