HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.2 0 4 3 1 of 2 0 1 8 ORDER: - Heard learned Counsel appearing for the petitioner and the learned Government Pleader for Mines and Geology for respondents. The petitioner herein made applications for grant of quarry leases in respect of the lands in Sy.Nos.363, 365 to 404, 346, 348 to 351, 353 and 359 of North Amuluru village, Alluru Mandal, SPSR Nellore District.

The said applications were forwarded by the Assistant Director of Mines & Geology/4th respondent to the Tahsildar/8th respondent for ascertaining the classification and for availability of the area applied. Subsequently, pursuant to the rejection orders passed by the Tahsildar, vide Rc.Nos.390/2017 and 391/2017, dated 21.06.2017, the Zonal Joint Director of Mines & Geology, Guntur, issued show-cause notices to the petitioner vide proceedings No.4000/Q5/2017 and 4001/Q5/2017 asking the petitioner to show cause as to why action should not be initiated for rejection of the quarry leases of the petitioner herein. To the said show cause notices, according to the petitioner, he submitted explanations on 06.10.2017.

In the above background, the grievance of the petitioner in the present Writ Petition, as advocated by the learned Counsel for the petitioner, is that no action so far on the said explanations has been taken by the respondents herein and that in view of the same, the petitioner is sustaining irreparable loss and hardship. Having heard the learned Counsel for the petitioner and the learned Government Pleader, taking into consideration the

explanations offered by the petitioner herein, pursuant to the show cause notices vide proceedings No.4000/Q5/2017 and 4001/Q5/2017 are pending consideration before the 3rd respondent, this Court deems it appropriate to dispose of the Writ Petition, with a direction to the 3rd respondent herein to pass appropriate Orders on the show cause notices vide proceedings No.4000/Q5/2017 and 4001/Q5/2017, after considering the explanations offered by the petitioner herein, as expeditiously as possible, preferably within a period of two months from the date of receipt of a copy of this Order. Miscellaneous petitions pending, if any, shall stand disposed of. There shall be no order as to costs.
