The present Civil Revision Petition is filed questioning the correctness of the Order passed in I.A.No.1837 of 2006 in O.S.No.193 of 1999, dated 04.04.2009, which was filed under Order XXVI, Rule 9 of the Code of Civil Procedure for appointment of Commissioner.

However, it is submitted that the main suit itself came to be disposed of by the trial Court on 17.12.2011, and thus the subject matter of the revision petition has become infructuous. In view of the above, the Civil Revision Petition is dismissed as having become infructuous. As a sequel, the miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
