HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.2422 OF 2017 ORDER:

The case of the petitioner is that she is the owner of the land admeasuring Ac.3.13 cents in Sy.Nos.346/2, 3, 5, 6 and 408/2 at Satyavaram Village, Narsannapeta, Srikakulam District having inherited through her late husband. While so, the 3rd respondent officials visited the land of the petitioner admeasuring Ac.0.54 cents in Sy.No.408/2 and tried to take the possession of the same stating that the said is a Government Poramboke. Aggrieved by the same, the present writ petition is filed. Learned counsel for the petitioner submits that petitioner's name was entered in the revenue records and pattadar pass books in respect of the subject land along with other lands owned by the petitioner were issued to the petitioner. As such, the petitioner cannot be dispossessed from the subject land without following due process of law.

Learned Assistant Government Pleader for Revenue submits that the authorities will follow due process of law before taking possession of the subject land. In view of the above facts and circumstances, the respondents are directed not to dispossess the petitioner without following due process of law.

With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
